Network Rail Infrastructure Limited (“Network rail”) manages around 20,000 miles of track across the U.K. Many people own homes or land that border a railway embankment and some of these have problems with Japanese knotweed.

Famous Knotweed Cases Against Network Rail
Charles Lyndon was recently involved in the first Japanese knotweed case against Network Rail to come before a court. On 2 February 2017, Recorder Grubb at Cardiff County Court, handed down judgement in favour of our client. Recorder Grubb found that our client had successfully made out his claim in private nuisance against Network Rail.
It was found that not only had our client’s property suffered from encroachment, but also that the mere presence of knotweed on Network Rail’s land was an actionable interference with the use and enjoyment of our client’s land. As a result, our client was awarded damages for the cost of treatment and the residual reduction in value of his property after the treatment had been carried out.
