Undisclosed
Commissions

Recover compensation for hidden commissions on loans, insurance, and property-related services.

Undisclosed commissions affect a significant number of consumers, tenants, leaseholders and businesses every year. Whether you entered into a tenancy, took out a loan, purchased insurance, or relied on an intermediary for financial advice, you may have paid more than necessary because a lender, broker, landlord, or managing agent received a secret or insufficiently disclosed payment connected to your agreement.

What Are Undisclosed Commissions?

An undisclosed commission is any payment, fee, or financial incentive received by a landlord, agent, lender, broker, or intermediary without clear and informed disclosure to the customer. Such commissions typically arise where:

  • A broker receives a commission from a lender when arranging a loan;
  • An insurance intermediary earns a referral fee on a policy sold;
  • A landlord or managing agent receives financial incentives from insurers, contractors, or service providers;
  • A lender or broker recommends a product that pays them a commission, without properly disclosing this to the borrower.

Tenants Affected by Undisclosed Landlord Commissions

London Trocadero (2015) LLP v Picturehouse Cinemas Ltd [2025] EWHC 1247 (Ch)

In this landmark High Court decision, the Court ruled that a landlord responsible for insuring leased premises cannot charge tenants for landlord commissions without express authorisation under the terms of the lease. The ruling strengthens the ability of commercial clients to claim back secret commissions and reinforces the transparency in commercial leases.

What Compensation Can You Recover?

Depending on the circumstances, clients may be entitled to:

  • Repayment of the full commission;
  • Compensation for inflated premiums, repayments, or charges; and
  • Interest on sums wrongly paid.
